I have been asked today to discuss the difference between underinsured and uninsured motorist coverage. What is it? How does it work? And why is it critically important that you have as much as you can afford?

When you're in a motor vehicle accident, oftentimes your ability to recover is limited to the amount of insurance that the person who caused the accident has. In Pennsylvania, for instance, the minimum amount of liability coverage that's required by law is $15,000. If you don't have some other source of insurance, your recovery in that motor vehicle accident is gonna be limited to that $15,000. Uninsured motorist coverage covers situations where the person who hit you has no insurance at all. They're uninsured.

If you have $100,000 of uninsured motorist coverage and you're hit by someone who has no insurance, what that means is your own insurance company will pay you up to $100,000 for your injuries. Underinsured motorist coverage is similar, but it involves situations where the person who hits you, in fact, has insurance, they just don't have enough to cover the damage that they've done. Let's go back to that situation where we have a defendant who has a minimum policy, say $15,000. Let's say you have $1 million of underinsured motorist coverage and you're traumatically injured in this accident. What happens is that the defendant's policy will be tendered to us.

We'll get you that $15,000, but your injury might be worth a half a million. So they are underinsured by $485,000. Well, fortunately, in this scenario, you have $1 million of underinsured motorist coverage. And what your own insurance company does is then steps in and would pay you that $485,000.

$85,000. So you can see that in that scenario, being properly insured resulted in almost 99% of your recovery. Purchase as much underinsured and uninsured motorist coverage as you can afford because you never want to rely on the person that hits you to be properly insured or even have insurance at all.
