Hi, this is Gabriel Levin, the founder and owner of The Levin Firm. I've been asked to speak about trucking accidents and what kind of things are taken into consideration when prosecuting a truck accident claim. First of all, you have to determine who the defendant is. Oftentimes, trucks are independently contracted and not controlled by a larger corporation. If that's the case, you have to determine who owns the truck and who to sue.
Other times, the driver is an employee of a larger corporation. A corporation may have many hundreds of trucks. These drivers have an enormous responsibility because they are behind the wheel of an enormously large vehicle that can do extraordinary damage in a very short amount of time, even when the accident occurs at low speed. Fortunately, there's a variety of ways that we can determine the extent and nature of the harm. Oftentimes, tractor-trailers will have video surveillance, both for inside of the cabin and outside of the tractor-trailer.
I can't tell you how many times I've caught drivers playing on their phones, changing the radio station, getting something to drink, and when they take their attention off the road, they end up hitting somebody. These tractor-trailers tend to have very large insurance policies. The reason for that is that they work often for very large corporations and they want to ensure against their corporation being held personally liable for the harm that it caused. As a result, these claims can be very large and require a lot of money to prosecute.
