Prisoners Rights

The prisoners rights lawyers at our office understand that people makes mistakes, and sometimes, those mistakes are serious enough to land a person in jail. While incarcerated, prisoners do give up a number of rights to which society is entitled, most notably the right to liberty. At prison facilities, people can suffer from an injury that may give them a right to recover. The attorneys at the Philadelphia, PA prison injury law firm of The Levin Firm believer that even while serving time in jail or prison, criminal offenders may not be denied many fundamental human rights. Some of these rights include:

  • freedom of expression and communication;
  • freedom of religion;
  • freedom from arbitrary punishments and cruel and unusual punishments;
  • freedom from discrimination on the basis of race, religion, national origin or gender;
  • treatment for certain medical conditions;
  • a comfortable temperature with sufficient ventilation and light; and
  • provisions for adequate nutrition and personal hygiene.

Prisoners’ rights may be violated in other ways. Security guards may turn a blind eye to prisoners who are being abused, or may engage in abuse themselves. Prisoners may be denied the right to read certain materials, such as their religion’s holy book. The facility may not have adequate information to help the inmates learn their legal rights, or may block access the justice system.

There are also a number of rights to which prisoners are not entitled. Prisoners have no right to parole, or to have an attorney present at a parole hearing or parole revocation hearing. There is no right to a particular classification (i.e. minimum security, solitary confinement, etc.). Prisoners may not vote in elections. Their right to freedom of speech is also limited.

Civil rights cases are complex, and require attorneys who understand the laws and how to aggressively represent their clients. At The Levin Firm, our attorneys will investigate your civil rights case. We consider many factors, including whether your rights have been violated, whether you have been damaged, whether there is evidence of a discriminatory motive, and if there has been a pattern of unfairness against other people.

Prisoners may not have the same rights as individuals living in free society, but they still deserve to be treated like human beings. At The Levin Firm, we have been handling civil rights claims for years, and we take these cases seriously. Many of these cases require immediate investigation, and we know that taking prompt action and obtaining as much documentation as possible can be difference between winning and losing. Our attorneys work together with a team of investigators and support staff to investigate every claim so that we may aggressively and zealously represent our clients and obtain the best possible results.
