Hot Tub Drowning Accidents

Losing a child in a preventable accident is especially difficult because the death could have been avoided if everyone had acted with the requisite amount of care for the situation. Fatal Hot Tub Accidents

The Consumer Products Safety Commission (CPSC) reports that hundreds of children drown every year in hot tubs. The most common reasons for accidental drowning in hot tubs include:

  • Improper fencing around the hot tub allowing children to have access without an adult
  • Improper supervision of children in the hot tub
  • Too high of temperature of the hot tub water (over 104 degrees Fahrenheit)
  • Hair entanglement in drain covers
  • Trapped limbs or disembowelment due to extreme suction in drains

Suction from drains is a bigger problem for small children than one may imagine and has become the subject of legislation in recent years. The Virginia Graeme Baker Pool and Spa Act was enacted after a young girl drowned after she became entrapped under water due to the extreme suction from a hot tub drain. The Act requires all hot tub owners to have proper drain covers that meet certain safety standards. Drain covers may often become brittle or crack due to the hot water in a hot tub. Therefore, all hot tub owners should regularly check their drain covers to make sure they meet the safety standards required by law. If a person fails to keep up their drain covers or comply with the law and you child is injured or killed as a result, the negligent hot tub owner should compensate you and your family for the loss of your child.
