When is a Construction Company Liable for my Personal Injuries?

construction work zoneWhen people think of injuries suffered on construction sites, they likely think of injuries suffered by construction workers [1]. However, many people who are not part of a construction crew suffered serious injuries on or around construction sites. Such injuries can be extremely serious and may require extensive medical treatment and recovery time. If you suffered a construction-related injury because a worker or company was negligent in some way, you have the legal right to hold that negligent party responsible by filing a personal injury claim.

Traffic-related construction accidents

The Centers for Disease Control and Prevention (CDC) reports [2] that hundreds of construction workers are killed while working in highway or roadway work zones every year. However, construction zones may also be extremely dangerous for motorists passing through these work zones. Construction zones may often include barrels, lane closures, lane changes, confusing signs, and more that may make it difficult for a motorist to safely traverse these sites.

In addition to the inherent risks of road work zones, the risk of accidents and injuries only increases if a worker or company management fails to act in a safe manner. Examples of negligence that may cause accidents include the following:

  • Not properly warning motorist of upcoming road work
  • Not properly marking or blocking off potential road hazards such as holes in the road or uneven lanes
  • Failing to safely direct traffic when needed
  • Leaving vehicles, tools, or other objects in open traffic lanes
  • Workers walking into oncoming traffic with no warning

Injuries while passing by construction sites

In addition to road work zones, pedestrians and bicyclists may also be in danger when passing by a construction site. Falling tools, exposed electrical wires, collapsing ground or trenches, and more can pose serious risks to anyone who is near a construction site. Construction workers should be aware of the dangers of construction sites and should always uphold a high standard of safety and care to avoid injuries. Unfortunately, this does not always happen. In such situations, an attorney can help to identify whether your accident was caused by the negligent acts or omissions of a constructions worker and can help you hold the company liable for your injury-related losses.
